1. ACCEPTANCE OF THE TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between Intelligent Product Artisans OÜ, an Estonian company (registry code: 17398018) ("Company", "we", "us", or "our"), and you ("User", "you"). By accessing or using the Ozempal website and tracking platform (the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, you must immediately cease all use of the Service.

2. MEDICAL DISCLAIMER (READ CAREFULLY)

OZEMPAL IS NOT A MEDICAL SERVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

  • No Professional Relationship: Use of the Service does not create a doctor-patient relationship.
  • Informational Purposes Only: The Service is a manual tracking and logging tool for personal wellness. All calculations, charts, and insights provided by the Service are for informational purposes only.
  • Consult a Healthcare Professional: You should never disregard professional medical advice or delay seeking it because of information provided by the Service. Always consult with your physician regarding medications, dosages, and side effects.
  • Not a Medical Device: Ozempal is not intended for use in the diagnosis of disease or other conditions, or in the cure, mitigation, treatment, or prevention of disease.
  • Emergency Situations: In the event of a medical emergency, contact your local emergency services immediately.

3. ELIGIBILITY AND ACCOUNT SECURITY

  • Age Requirement: You must be at least 18 years of age to use the Service.
  • Account Creation: You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the confidentiality of your login credentials.
  • Manual Entry: You acknowledge that the Service does not integrate with third-party health apps (e.g., Apple Health, Google Fit). You are solely responsible for the accuracy and completeness of the data you manually enter.

4. USER CONTENT AND DATA

  • Ownership: You retain all ownership rights to the data, text, and photos you upload to the Service ("User Content").
  • License: You grant the Company a worldwide, non-exclusive, royalty-free license to host, store, and display your User Content solely for the purpose of providing the Service to you.
  • Prohibited Content: You agree not to upload content that is illegal, harmful, or violates the rights of others.

5. INTELLECTUAL PROPERTY RIGHTS

The Service, including its interface, code, graphics, and trademarks, is the exclusive property of Intelligent Product Artisans OÜ. You may not copy, modify, distribute, or reverse-engineer any part of our intellectual property.

6. PROHIBITED USES

You agree not to:

  • Use the Service for any commercial purpose without our prior written consent.
  • Attempt to bypass any security measures or gain unauthorized access to our servers.
  • Use automated systems (bots, scrapers) to access the Service.
  • Use the Service to track data for anyone other than yourself.

7. LIMITATION OF LIABILITY

To the fullest extent permitted by Estonian law:

  • The Company shall not be liable for any indirect, incidental, or consequential damages.
  • The Company is not responsible for any health-related outcomes, medication errors, or side effects related to your health journey or the data you track on the platform.
  • Our total liability for any claim arising out of or relating to these Terms shall not exceed the amount you paid us to use the Service in the last six months.

8. INDEMNIFICATION

You agree to indemnify and hold harmless Intelligent Product Artisans OÜ and its officers from and against any claims, damages, or expenses (including legal fees) arising from your use of the Service or your violation of these Terms.

9. TERMINATION

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or for any other reason deemed necessary to protect the Service. You may delete your account and data at any time through the platform settings.

10. GOVERNING LAW AND JURISDICTION

These Terms are governed by and construed in accordance with the laws of Estonia. Any disputes arising from these Terms or the use of the Service shall be settled in Harju County Court (Harju Maakohus) in Tallinn, Estonia.

11. AMENDMENTS

We may update these Terms from time to time. If we make material changes, we will notify you by posting a notice on our website or via email. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
